Incoterms

What are?

“Incoterms” is the short and succinct way of saying International Trade Terms. They were first published in 1936, and today they consist of a set of 11 rules that define who is responsible for different tasks during international transactions.

Why are they so important?

Because they are recognized and accepted from Austin to Zanzibar. As a requirement on all commercial invoices, Incoterms significantly reduce the risk of misunderstandings with potentially high costs.

What do they cover?

Incoterms specify all tasks, risks and costs involved in the transaction of products between the seller and the buyer.

Incoterms® 2010

EXW

EX WORKS (named place of delivery) NA ORIGEM (local de entrega nomeado) O vendedor limita-se a colocar a mercadoria à disposição do comprador no seu domicílio, no prazo estabelecido, não se responsabilizando pelo desembaraço para exportação nem pelo carregamento da mercadoria em qualquer veículo coletor.Utilizável em qualquer modalidade de transporte.Nota: em virtude de o comprador estrangeiro não dispor de condições legais para providenciar o desembaraço para saída de bens do País, fica subentendido que esta providência é adotada pelo vendedor, sob suas expensas e riscos, no caso da exportação brasileira.

FCA

FREE CARRIER(named place of delivery) LIVRE NO TRANSPORTADOR (local de entrega nomeado) O vendedor completa suas obrigações e encerra sua responsabilidade quando entrega a mercadoria, desembaraçada para a exportação, ao transportador ou a outra pessoa indicada pelo comprador, no local nomeado do país de origem.Utilizável em qualquer modalidade de transporte.

FAS

FREE ALONGSIDE SHIP (named port of shipment) LIVRE AO LADO DO NAVIO (porto de embarque nomeado) O vendedor encerra suas obrigações no momento em que a mercadoria é colocada, desembaraçada para exportação, ao longo do costado do navio transportador indicado pelo comprador, no cais ou em embarcações utilizadas para carregamento da mercadoria, no porto de embarque nomeado pelo comprador.Utilizável exclusivamente no transporte aquaviário (marítimo ou hidroviário interior).

FOB

FREE ON BOARD (named port of shipment) LIVRE A BORDO (porto de embarque nomeado) O vendedor encerra suas obrigações e responsabilidades quando a mercadoria, desembaraçada para a exportação, é entregue, arrumada, a bordo do navio no porto de embarque, ambos indicados pelo comprador, na data ou dentro do período acordado.Utilizável exclusivamente no transporte aquaviário (marítimo ou hidroviário interior).

CFR

COST AND FREIGHT (named port of destination) CUSTO E FRETE (porto de destino nomeado) Além de arcar com obrigações e riscos previstos para o termo FOB, o vendedor contrata e paga frete e custos necessários para levar a mercadoria até o porto de destino combinado.Utilizável exclusivamente no transporte aquaviário (marítimo ou hidroviário interior).

CIF

COST, INSURANCE AND FREIGHT (named port of destination) COST, INSURANCE AND FREIGHT (named port of destination) In addition to bearing the obligations and risks foreseen for the FOB term, the seller contracts and pays freight, costs and insurance related to the transport of the goods to the combined port of destination. Exclusively usable in water transport (sea or inland waterway).

CPT

CARRIAGE PAID TO (named place of destination) PAID TRANSPORTATION TO (named place of destination) In addition to bearing obligations and risks foreseen for the FCA term, the seller contracts and pays freight and costs necessary to take the goods to the agreed place of destination .Usable in any mode of transport.

CIP

CARRIAGE AND INSURANCE PAID TO (named place of destination) TRANSPORT AND INSURANCE PAID TO (named place of destination) In addition to bearing the obligations and risks foreseen for the FCA term, the seller contracts and pays freight, costs and insurance related to the transport of the goods to the agreed place of destination.Usable in any mode of transport.

DAT

DELIVERED AT TERMINAL (named terminal at port or place of destination) DELIVERED AT TERMINAL (named terminal at port or place of destination) The seller completes its obligations and terminates its responsibility when the goods are made available to the buyer, on or within the agreed period, at a named destination terminal (pier, container terminal or warehouse, among others), unloaded from the transport vehicle but not cleared for import.Usable in any mode of transport.

DAP

DELIVERED AT PLACE (named place of destination) DELIVERED AT PLACE (named place of destination) The seller completes his obligations and ends his responsibility when he places the goods at the disposal of the buyer, on the date or within the agreed period, at a place of destination indicated that is not a terminal, ready to be unloaded from the transport vehicle and not cleared for import.Usable in any mode of transport.

DDP

DELIVERED DUTY PAID (named place of destination) DELIVERED DUTIES PAID (named place of destination) The seller completes its obligations and ends its responsibility when the goods are placed at the disposal of the buyer, on the date or within the agreed period, at the place of destination designated in the importing country, not unloaded from the means of transport. The seller, in addition to the clearance, assumes all risks and costs, including taxes, fees and other charges levied on import.Usable in any mode of transport.Note: because the foreign seller does not have legal conditions to provide clearance for entry of goods from the Country, this term cannot be used in Brazilian importation, and the DAT or DAP must be chosen in the case of preference for a condition disciplined by the ICC.
